Finding foreclosures is not that hard. All you really need to do is become friends with your local foreclosure lawyers. They know everything that is going on in the home foreclosure “business” which is of course thriving in this backwards economic climate.

The legal act of foreclosure is encountered in real estate law and covers both commercial and residential properties. A real estate lawyer will usually engage in this activity, but since real estate law is a much wider field of expertise of which foreclosure makes up only a component, it is rare that lawyers will stick with this as their specialty. However, since in a majority of cases it is a financial institution that involves itself in foreclosure actions, sometimes the institutions will hire staff lawyers who are relied upon solely to serve the purpose of foreclosure counsel.

Under terms of a foreclosure by power of sale, no judicial supervision is involved in the transaction because of the inclusion in the mortgage agreement of a “power of sale” clause. Again, the lawyer may negotiate to secure the best result for the client, but no case is presented to a court and the sale is initiated and completed independently. This why you are always finding foreclosures in newspapers. Usually the terms have a clause that says that the sale must be advertised to the public.

It’s known that a financial institution is often the lender who seeks a foreclosure order; however, in some cases it is the property’s previous owner who serves as the mortgagor. This process is known as a “purchase money mortgage” and is subject to the same foreclosure laws that apply to institutional lenders. Either way finding foreclosures is easiest if you know someone who is handling them in the law or real estate business on one level or another.
